As we move forward, Calendars 5 is making way for Calendars, our flagship planner application, we will sunset the Calendars 5 App on 30 June 2024.
Our commitment to providing high-quality services remains unchanged, and we are dedicated to ensuring a smooth transition to Calendars for all our users.
Please take a moment to review the following information carefully:
Effective 30 June 2024, the Calendars 5 App will no longer be supported. This means that we will cease all development activities for the App, including updates, bug fixes, and customer support. Users are encouraged to download any data or content they wish to retain prior to this date. Personal data should be further processed and deleted according to the Privacy Notice for Calendars 5.
You can continue to use the Calendars 5 App after the sunset date. However, no further updates or bug fixes will be released for the App. The App will remain in its current state, and users may experience diminished functionality over time as operating systems and devices evolve.
We are pleased to offer you the best terms to subscribe to the Calendars App. Details of this offer will be communicated to you in the Calendars 5 App before transition.
We waive all responsibility for the performance, functionality, and security of the App following its sunset. You acknowledge that continued use of the app after the sunset date is entirely at your own risk. We will not be liable for any issues, including but not limited to, data loss, security vulnerabilities, or diminished functionality, that may arise post-sunset. By continuing to use the app after the sunset date, users agree to hold us harmless from any and all claims, damages, or losses that may result from their continued use of the App.
Certain provisions of these Terms of Service are designed to survive the sunset of the Calendars 5 App. These provisions include, but are not limited to, sections regarding license terms, limitation of liability, indemnification, dispute resolution, and other provisions that, by their nature, should survive.
By continuing to use the App up to and beyond the sunset date, you acknowledge and agree to the above terms. If you have any questions or need assistance, please contact our support team prior to 30 June 2024.
Readdle Limited (“Readdle” or “we”) welcomes you, our user (“User” or “you”). We provide you with our application “Calendars 5” (“App” or “Calendars 5”), available on iOS, iPadOS, and watchOS, subject to the terms and conditions of our Terms of Service (“Terms”).
We have two Privacy Notices that you should know about. Our Privacy Notice for Calendars 5 describes our collection and use of personal data connected to your access to and use of the App. The second one – Privacy Notice for Readdle Website – is for our website, which you can access by following the link (“Website”).
By installing the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you are not permitted to and must discontinue using the App.

The App is available for the iOS, iPadOS, and watchOS platforms on the App Store. Please note, that the scope of functionality of the App may differ for the different platforms.
Upon installation of the App, please connect at least one of your calendars. The more calendars you connect, the better experience you get.
To use the App, you have to purchase a lifetime subscription to the Calendars 5 subscription plan, subject to the then-current one-time subscription fee (including VAT, if applicable) shown in the App.
The subscription is universal across the available platforms and provides a set of features available in the then-current version of the Calendars 5 subscription plan depending on the platform. The subscription plan is compatible with the Family Sharing feature of the App Store.
We reserve the right to change the Calendars 5 subscription plan, including the list of the features available, at any time by providing you with adequate notice. If you do not agree to use the updated subscription plan, you can cancel your subscription.
We may provide you with some additional features available subject to the one-time or periodical fee (including VAT, if applicable) shown in the App.
We reserve the right to change the list of the paid-for features at any time by providing you with adequate notice. If you do not agree to use the updated list of the paid-for features, you can cancel them if they are charged on a periodical basis.
Your payments are processed via the App Store.
Please note, that if you pay in a currency that is different from the currency in which the fees are quoted, your bank may apply its current exchange rate and/or add commissions and fees on top of our subscription fees.
The periodical fees for the paid-for features will be automatically charged for the subsequent period unless you cancel it at least 24 hours before the billing date in your device settings.
You have to take the following steps to cancel your subscription to the Calendars 5 subscription plan or periodical fees for the paid-for features:

Upon cancellation, your access to the additional features available under the Calendars 5 subscription plan features or the paid-for features will remain for 24 hours upon the cancellation.
If you have any problems with the functioning of the App, please contact us, and we will make every effort to help you.
Your purchases made through the App Store may be refunded by contacting Apple support directly and requesting a refund.

We do not provide services or access to our products to new customers from the Russian Federation and the Republic of Belarus. The existing customers from the said countries retain access to the installed App, but they will not have access to the App updates or our customer support service.
Readdle does not engage in any business with companies owned by or affiliated with the citizens of the Russian Federation or the Republic of Belarus.
Readdle does not engage in business with companies that support the Russian aggression in Ukraine.
In brief:
We do not provide cloud services. All files and materials you access or manage through the App are stored locally on your devices or connected cloud services. We neither have access to the data stored on your device nor do we store it anywhere. The integration between your cloud storage provider and the App on your device is also performed directly per your cloud service provider’s security requirements.
Some features of the App are available in compatibility with third-party websites and services, including, without limitation, the connected cloud services, file converting services, FTP, SFTP, WebDAV, SMB, and other integrations. We cannot guarantee that any currently supported third-party services will remain compatible with the App software, and that all features will be constantly available and uninterrupted.
We do not store your login information when you connect third-party accounts (for example, Google Calendar). We have temporary access to your authentication credentials when you log in. You are solely responsible for maintaining the confidentiality of your login information and all activities performed under your credentials.
If you know or have any reason to suspect that someone has gained access to your Account without your authorization or your credentials have been lost, stolen, misappropriated, or otherwise compromised, please immediately notify us by email: rdsupport@readdle.com.
You acknowledge that different terms of service (or equivalents) and privacy policies may apply to your use of third-party websites, services, and content. Readdle shall not be held responsible for any loss, damage, or other liabilities incurred as a result of your interaction with those third-party websites and services.

The App is owned and managed by Readdle or our affiliates.
The App and the materials in the App, including text, graphics, information, images, drawings, trademarks, logos, video, sounds, music, software, and other materials (collectively, “Content”), as well as copyright and other intellectual property rights to such Content belong to Readdle or our affiliates or is included in the App with the consent of the owner.
The Content does not include any materials you upload to or otherwise provide while using the App.
Subject to your compliance with these Terms, we grant you a limited, temporary, personal, non-exclusive, non-sublicensable, revocable, non-transferable, worldwide license to download and use the App on the device(s) that you lawfully own or control in the manner provided for in these Terms for personal non-commercial or internal business purposes.
Readdle may provide upgrades, modifications, updates, or additions to the App. The terms of this license shall apply to any such modification unless a separate license accompanies it.
Under this license, you shall not:
Your license to use the App shall be automatically revoked if you violate these Terms. We reserve all rights not expressly stated in these Terms.
We will enforce our intellectual property rights and use any remedy available under the applicable law.
You own and are solely responsible for any files, including pictures, text, videos, sound recordings, and other materials that you submit through the App.
We welcome feedback, reviews, ideas, questions, and comments about your experience with our App (collectively “Feedback”). By submitting your Feedback to us directly or via any platform, including, but not limited to, online distribution platforms, marketplaces, and social media, you:

The Feedback appearing on our website, social media accounts, and marketing, advertising, and other communication reflects the individual experience of those who have used our App. We do not claim, nor should the reader assume, that any individual experience recounted is typical or representative of what any other user might experience.

Readdle warrants that the App will perform substantially according to its documentation within the period of your license. Readdle disclaims all other warranties regarding the App, its features, and content to the fullest extent permitted by law, including without restrictions, guarantees of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights of third parties or other rights.
We are not making any promises, including the App’s and Content’s accuracy, usefulness, reliability, and correct operation. Readdle does not guarantee that the App will be uninterrupted or secure, that any defects will be corrected, or that the App is free of viruses or anything else harmful.

We shall not accept responsibility if any information, materials, or content available through the App is inaccurate or incomplete.
You are solely responsible for the legality of your actions within the App and your use of the App under the laws and regulations applicable to you and for your compliance with the terms of service (or equivalents) and privacy policies of the third-party websites and services.
In no event shall Readdle, its subsidiaries, directors, partners, employees, contractors, or agents be liable for indirect, incidental, special, punitive, or consequential damages related to any use or inability to use the App (e.g., if Apple Inc. terminates the Users’ access to the App), including, without limitation, any damages, caused as a result of the use of the information provided through the App or by mistakes, omissions, interruptions, defects, viruses, even if Readdle has been advised of the possibility of such damages.
The preceding limitations of liability do not apply to the extent prohibited by law.
If any part of the warranty disclaimers or limitations of liability is found to be invalid or unenforceable for any reason or if we are otherwise found to be liable to you in any manner, then our aggregate liability for all claims under such circumstances for liabilities shall not exceed the total amount of payments made by you to Readdle within one year preceding the claim.

Except as otherwise outlined in these Terms, these Terms shall be exclusively governed by and construed under the laws of the Republic of Ireland, excluding the rules on conflict of laws.
If any material in the App, or your use of it, is contrary to the laws of the place where you are when you access it, the App is not intended for you, and we ask you not to use it. You are responsible for informing yourself of the laws of your jurisdiction and complying with them.
Except where prohibited by applicable law, and without limitation to any statutory rights of consumers, you agree that any dispute, conflict, claim, or controversy directly or indirectly arising out of in connection with or relating to the App or these Terms, including, without limitation, those relating to its validity, its construction or its enforceability shall be resolved through amicable negotiations directly with Readdle team following the principles of good faith and cooperation.
If we cannot reach a consensus through negotiations, the dispute shall be settled exclusively in the national courts of the Republic of Ireland, subject to its jurisdiction rules, with the applicable substantive law of the Republic of Ireland.
You can also try to settle the dispute out of court using an alternative dispute resolution procedure and submit your complaint online via the online dispute resolution (ODR) platform.
All claims shall be brought within one year after the claim arises, except to the extent a more extended period is required by applicable law.

At any time, at our sole discretion, we reserve the right with prior notice to modify, suspend, or discontinue the App, Content, features, or offers in the App. You agree that we shall not be liable to you or any third party should any preceding occur concerning the App.
We reserve the right to take whatever legal actions we may deem appropriate in response to actual or suspected violations of these Terms, including, without limitation, the suspension or termination of your license and access to the App.
We will cooperate with legal authorities and/or third parties to investigate any suspected or alleged crime or civil wrong.
You may terminate your access and use of the App at any time by deleting and no longer accessing or using the App unless you have an active subscription (see below). If you terminate the use of the App, all permissions and licenses provided to you under these Terms will immediately terminate without Readdle’s obligation to provide any refunds.
Please note that when you delete the App on your device with an active recurring subscription, it does not automatically cancel it. You must manually cancel your subscription (please see Subscription Cancellation above).
We reserve the right to transfer our rights and obligations under these Terms to a third party, but this will not affect your rights or our obligations under these Terms.
We reserve the right to modify these Terms at any time at our sole discretion. If material changes affect your use of the App, we’ll notify you before the changes’ effective date by sending you an email or displaying the changes on the website or in the App. If you continue to use the App, you agree to the updated version of these Terms.
If any provision of these Terms is recognized unlawful, void, or unenforceable by a relevant authority, the remaining provisions will remain valid and enforceable.
A printed version of these Terms shall be admissible in judicial or administrative proceedings based on or relating to the use of the App to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
